Nigerian Court To Rule On NIBSS’s Exclusive Control Of BVN Database.

The Federal High Court in Abuja has scheduled 26 May to hear a significant case brought by the Nigeria Inter-Bank Settlement System (NIBSS) Plc against the Central Bank of Nigeria (CBN) and others, as NIBSS seeks to affirm its statutory authority to manage the Bank Verification Number (BVN) database.

 

The BVN, a unique identifier that verifies individual bank accounts across Nigeria’s banking sector, is integral to financial operations and linked to the National Identification Number (NIN). Both are critical for accessing services such as banking, mobile phone usage, passport applications, and other governmental and private services, making them essential to daily life in Nigeria.





 

NIBSS, represented by Senior Advocate of Nigeria Ademolai Esan, is seeking a court declaration to confirm its exclusive role in maintaining and managing the BVN database, as stipulated under its operational framework. The suit names the Digital Rights Lawyers Initiative (ITDRLI), the CBN, and the Attorney-General of the Federation as defendants. NIBSS alleges that ITDRLI has filed multiple lawsuits, directly or through proxies, challenging its authority and claiming that its management of the BVN database infringes on constitutional privacy rights.

 

The case, presided over by Judge James Omotosho, follows the dismissal of an application by the Data Privacy Lawyers Association (DPLAN) to join the proceedings. ITDRLI has denied the allegations and urged the court to dismiss NIBSS’s suit.

 

The dispute has sparked broader concerns about data privacy and surveillance, given the sensitive biometric and personal information stored in the BVN and NIN databases. As digital platforms become increasingly vital for everyday activities, the outcome of this case could set a precedent for the governance of critical identity systems in Nigeria.

 

NIBSS’s push to secure its role underscores the importance of a robust and secure framework for managing the BVN database, ensuring seamless operations and safeguarding the financial and personal data of millions of Nigerians. The court’s ruling on 26 May is expected to provide clarity on the management of this vital national resource, reinforcing confidence in Nigeria’s financial and identification systems.
